About These Terms
Guardian Apps LLC mobile applications — including Guardian Inspection and DECISIO — and all associated websites, digital services, and platform integrations (collectively, the "Services") are developed, owned, and operated by Guardian Apps LLC ("we," "us," "our").
By downloading, installing, accessing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Services.
Informational Purpose Only
Our applications use artificial intelligence and automated systems to generate outputs including — but not limited to — hazard assessments, inspection reports, meeting transcripts, action items, summaries, analyses, and recommendations. All such outputs are provided for general informational and reference purposes only.
AI-generated outputs are NOT a substitute for consultation with qualified professionals in the relevant field; licensed professional inspections or certifications where required; official regulatory guidance; or independent human judgment before consequential decisions are made.
Users must independently verify the accuracy, completeness, and legal sufficiency of all results before relying on them for any purpose.
No Guarantee of Accuracy or Compliance
Guardian Apps LLC makes no representations or warranties regarding the accuracy, completeness, or reliability of any output generated by our applications. Use of our applications does not constitute or guarantee compliance with any regulatory framework. AI systems are inherently probabilistic and may produce outputs that are inaccurate, incomplete, biased, or misleading.
User Responsibility
All decisions, actions, and outcomes based on use of the Services remain solely the responsibility of the user. You are responsible for evaluating the fitness of any output before relying on it; ensuring your use complies with all applicable laws and workplace policies; obtaining all necessary consents before capturing or processing data belonging to third parties; and ensuring recordings comply with applicable wiretapping and consent laws in your jurisdiction.
No Liability
To the maximum extent permitted by applicable law, Guardian Apps LLC disclaims all liability for direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from use of the Services, regardless of the theory of liability. This includes any injury, death, property damage, regulatory penalty, loss of profits, data loss, or decisions made based on App content or outputs.
Privacy and Data
Your use of the Services is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Users are responsible for ensuring compliance with all applicable privacy and data-protection requirements within their organization and jurisdiction. Users must not upload, store, or process any content they are not lawfully authorized to handle.
No Professional-Client Relationship
Use of the Services does not create a professional-client, consultant-client, attorney-client, fiduciary, agency, or any other professional or special relationship between the user and Guardian Apps LLC. Nothing in the Services constitutes professional advice of any kind.
Acceptable Use
You agree NOT to: make consequential decisions based solely on AI-generated outputs without independent professional verification where such verification is required or prudent; attempt to bypass any security feature or authentication mechanism; reverse-engineer or create derivative works of any application; engage in automated scraping or data mining; infringe any intellectual-property or privacy right of any third party; upload content that is unlawful or that you do not have the legal right to process; or use our applications to develop a competing product.
We reserve the right to suspend or terminate your access for violation of these Terms without prior notice.
Artificial Intelligence Disclaimer
AI outputs are probabilistic in nature, generated by statistical models, not by human professionals. AI outputs may contain errors, inaccuracies, hallucinations, or reflect biases present in training data.
AI outputs do NOT constitute and shall not be relied upon as professional, safety, engineering, medical, legal, regulatory, or any other form of expert advice. All outputs require independent human review and professional judgment before any action is taken.
When you use AI features, text content may be transmitted to Anthropic, our AI service provider, solely to generate results for you. For features involving audio recording, transcription occurs entirely on your device — no audio is ever transmitted to Anthropic or any other third party. We disclaim all liability for any results produced by AI systems.
Indemnification
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Guardian Apps LLC and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses arising out of or related to your use of the Services, your violation of these Terms, or any claim that your content or use of the Services infringes the rights of a third party.
Warranty Disclaimer
THE SERVICES, INCLUDING ALL APP FEATURES, AI OUTPUTS, CONTENT, AND DATA, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE EXPRESSLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, AND NON-INFRINGEMENT.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUARDIAN APPS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, REGARDLESS OF THE THEORY OF LIABILITY.
In no event shall the total aggregate liability of Guardian Apps LLC for all claims exceed the greater of USD $100.00 or the total amounts you have actually paid to Guardian Apps LLC in the twelve months preceding the event giving rise to the claim.
Intellectual Property
The Services, including all software, content, design, trademarks, and logos, are the exclusive property of Guardian Apps LLC or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal or internal business purposes. This license does not include the right to modify, distribute, sell, or create derivative works. You retain ownership of content you create and upload.
Children's Privacy and Age Requirements
The Services are not directed to children under 13 (U.S., COPPA) or under 16 (EEA/UK, GDPR). If you do not meet the applicable minimum age in your jurisdiction, you must not use the Services.
Paid Features, Subscriptions, and Refunds
- All billing, payment processing, and refund handling are managed exclusively by the Apple App Store
- Guardian Apps LLC does not collect, store, or process payment-card data
- Refund requests must be directed to Apple directly
- We reserve the right to change pricing at any time; changes take effect at the next renewal period
Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to conflict-of-law principles. You consent to the exclusive personal jurisdiction and venue of the state and federal courts located in Texas, except where applicable mandatory law grants you the right to bring proceedings in your jurisdiction of residence.
If you are a consumer in the EEA or UK, nothing in these Terms deprives you of the protection afforded by the mandatory provisions of the law of your country of habitual residence.
Acceptance of Terms
By downloading, installing, accessing, or using the Services, you acknowledge and agree that you have read, understood, and agree to be bound by these Terms; you have read and agree to our Privacy Policy; you meet the minimum age requirement for your jurisdiction; and you accept full responsibility for your use of the Services and all AI-generated outputs.
If you do not agree to any part of these Terms, you must immediately discontinue all use of the Services and delete the App from your devices.
